Terms of Service
1. About Sunstead
Sunstead is a home solar monitoring service operated by Stillridge Labs ("Stillridge Labs", "we", "us"), a sole proprietorship registered in Alberta, Canada. The service includes the Sunstead mobile application, the website at sunstead.stillridgelabs.com, and the API behind them. Sunstead helps a household see what its solar system generates, what the home uses, what the utility bills come to, and when a seasonal rate switch is likely to pay.
2. Eligibility
Sunstead is intended for people aged 13 and older. By creating an account you confirm you are at least 13. If you are under 18, we encourage parental awareness of your use of the service.
3. Your account
You are responsible for keeping your password secure and for activity that happens under your account. Do not share your password. If you believe your account has been compromised, contact [email protected] promptly. We may suspend or close accounts that violate these terms, abuse the service, or create technical or legal risk for other users or for Stillridge Labs. Suspended means you cannot sign in and any open sessions are ended; your data is kept and the suspension can be lifted. Closed means the same, and the account and everything it owns is deleted 30 days later unless we reopen it in that time. In either case the reason is shown when you try to sign in, and you can write to [email protected].
4. Your data
The readings you enter, the inverter data fetched on your behalf, the bills you record, and the settings you choose are yours. You grant Stillridge Labs only the licence needed to store, process, and display that data to you and to the household members you invite, for the purpose of providing the service. We do not sell it, license it, or share it beyond what the Privacy Policy describes.
5. Third-party services and credentials
To read your inverter data, Sunstead uses APsystems' API with credentials you provide. You are responsible for having the right to use those credentials and for complying with APsystems' terms. Sunstead calls that API on your behalf, within its rate limits; we may reduce polling to stay inside them. Weather data comes from Open-Meteo. We do not control either service and are not responsible for their availability or accuracy.
6. Estimates are information, not advice
Sunstead computes bill estimates, cost and earnings figures, payback projections, and rate-switch timing from your data and the rate tables you enter. These are estimates. They may be wrong, out of date, or based on incomplete readings, and your utility's invoice is the only figure that binds you. Sunstead is a decision-support tool. It is not financial, legal, or energy advice, and Stillridge Labs is not a licensed adviser of any kind. Confirm rates and charges with your utility before acting on anything Sunstead shows.
6a. Rate-switch suggestions: a suggestion only, at your own risk
Sunstead may suggest a date on which switching between your retailer's rate plans (for example from a summer rate to a winter rate, or back) would have cost you less. This is a suggestion only. It is not a recommendation, not advice, and not a prediction.
The suggestion is computed from the meter readings you entered, the rate figures you entered, and an estimate of when your retailer will issue the invoice. Any of those can be wrong or incomplete. The suggestion can change as readings arrive, and the timing that turns out best can differ from what was suggested.
You must do your own calculation, and confirm the rates, the switch date, and the switch mechanics with your retailer, before making any switch. You alone decide whether and when to switch.
Stillridge Labs accepts no responsibility and no liability of any kind if a suggested switch, or a switch made at a time Sunstead suggested, turns out not to be optimal, costs you more than another choice would have, or is made at a time your retailer does not accept. This applies whether the suggestion was shown on the website, in the app, or in a notification, and whether or not it was accompanied by a dollar figure.
7. Household sharing
If you invite others to your system, they see that system's data at the role you give them. You are responsible for who you invite. An owner may remove members at any time. Members may leave by deleting their account.
7a. Deleting an account, and what happens to a household
- If you are a viewer or editor in someone else's household and delete your account, only your account is removed. The household and its data stay with its owner. Readings you entered stay with the household as its record of the meter, with your name removed.
- If you are the owner of a household and delete your account, the household goes with you: its readings, inverter data, bills, settings, and credentials are all deleted. Anyone else in that household keeps their own account but is left without a household. The app tells you how many people that affects before you confirm.
- Accounts left without a household for 90 days are deleted automatically.
- Accounts with no sign-in or other authenticated activity for one year are deleted automatically, along with any household they own.
- Deletion is immediate and cannot be undone.
8. Acceptable use
You agree not to:
- attempt to access accounts, data, or systems that are not yours;
- reverse-engineer, tamper with, or attack the app, website, or API;
- use automated means to load, scrape, or overwhelm the service;
- enter data you know to be false in order to mislead other members of a household;
- create multiple accounts to get around limits or suspensions;
- use the service in any way that breaks applicable law.
9. Price
Sunstead is currently offered without charge. If that changes, we will publish pricing and billing terms and give at least 30 days' notice before any charge applies to an existing account. Nothing in these terms commits you to pay anything today.
10. Intellectual property
The Sunstead app, website, code, design, and branding are owned by Stillridge Labs and protected by Canadian and international intellectual property law. You may not copy, redistribute, or create derivative works from them without written permission. Your data remains yours, as set out in section 4.
11. Disclaimer of warranties
Sunstead is provided "as is" and "as available". Stillridge Labs makes no warranty, express or implied, that the service will be uninterrupted, error-free, or accurate, or that any estimate it produces will match your bill. You use the service at your own risk.
12. Limitation of liability
To the maximum extent permitted by the law of Alberta and of Canada, Stillridge Labs is not liable for any indirect, incidental, special, or consequential damages arising from your use of Sunstead, including any loss from relying on an estimate, projection, or recommendation it shows. Our total liability to you for any claim arising from your use of Sunstead will not exceed the greater of (a) the fees you paid Stillridge Labs in the six months before the claim arose, or (b) $25 CAD.
13. Indemnification
You agree to indemnify and hold harmless Stillridge Labs (the registered trade name of the sole proprietorship operated by Todd Zmetana) and its agents and contractors from claims, liabilities, damages, and expenses, including reasonable legal fees, arising from your use of Sunstead in violation of these terms, from data you enter, or from your violation of any law or of the rights of any third party.
14. Governing law and disputes
Before filing any claim in court, you agree to contact us at [email protected] and attempt to resolve the matter informally for at least 30 days. If that fails, any dispute arising from these terms will be resolved in the courts of Calgary, Alberta. These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there.
15. Changes to these terms
We may update these terms as the service evolves. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after that date is acceptance of the updated terms.
16. Termination
You may stop using Sunstead and delete your account at any time from inside the app or on the website, with the consequences set out in section 7a. We may suspend or close your account if you violate these terms, and we delete accounts under the retention rules in section 7a. Sections 4, 6, 6a, 10, 11, 12, 13, and 14 survive termination.
17. Miscellaneous
If any provision of these terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest remains in force. These terms, together with the Privacy Policy, are the entire agreement between you and Stillridge Labs regarding Sunstead.
